Processing of your personal data as part of our services: 

For our customers or business partners, or in case you are interested in our services, the type, extent and purpose of processing your personal data are based on our contractual or pre-contractual relationships.

We process requested personal data or data you provided to us in order to reply to your request, to make an offer or to process your order. This affects interested parties, business partners and contractual partners. The purpose of processing is handling contractual services, communication, as well as answering contact requests and office and standard operating procedures. 

Unless mentioned differently in this data privacy statement, the processing of your personal data and its transfer to third parties is limited to necessary and appropriately required data to answer your requests and/or fulfill the contract and to protect our rights and to fulfill statutory duties.

The subject’s data are:

  • personal data (e.g. name, address)
  • payment details (e.g. bank details, invoices)
  • contact details (e.g. e-mail address, telephone number, postal address)
  • contract data (e.g. subject of the contract, duration of the contract)

The legal basis for data processing is Art. 6 I 1 lit. b GDPR, the fulfillment of the contract or the fulfillment of pre-contractual inquiries.

We will delete your personal data as soon as it is not needed any longer, i.e. after our contractual relationship has ended, or after our legitimate interest in further processing of your data no longer applies, or if you request us to delete it. Mandatory legal regulation – in particular statutory retention periods - remain unaffected.  It may also be necessary to process your personal data until the expiry of these periods in order to assert, exercise or defend legal claims arising from contractual relationships, or to protect the rights of another natural or legal person. We will then only delete the personal data required for this after these periods have expired. However, until these deadlines expire, we limit the processing of your data to these purposes.

Visiting these websites – processing of personal data and method and purpose of use

When you visit our website, you transmit (due to technical necessity) data to our web server via your internet browser. The following data is processed in the server log files during an ongoing connection between your internet browser and our web server: 

  • the page from which the file was requested - referrer URL
  • the file’s name 
  • the date and time of the request
  • a description of the type of web browser used / browser version and operating system
  • IP address of the requesting computer
  • the access status (file transferred, file not found, etc.)
  • the amount of data transferred

For technical reasons (accessing the website), this data is saved for a short time. It is not possible for us to draw conclusions about individual persons based on this data. After seven days at the latest, the IP address will be deleted or made anonymous.  

The data is evaluated exclusively for internal purposes and does not allow us to draw any conclusions about your person. There is no sharing with other databases. 

The data mentioned are processed for the following purposes:

  • ensuring proper and smooth link connection of the website,
  • ensuring comfortable use of the website, 
  • evaluation of system security and stability

The legal basis for data processing is Article 6 Paragraph 1 Sentence 1 lit. f GDPR. The legitimate interest arises from the data collection purposes listed above. We do not use under no circumstances the collected data for the purpose of drawing conclusions about your person. You can visit this website without providing any personal information.

Cookies

We use technically necessary session cookies on our website. Cookies are small files that your browser creates automatically and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not damage your end device and do not contain viruses, trojans or other malware.

Information is stored in the cookie that arises in connection with the specific end device used. However, this does not mean that we are immediately informed about your identity. Cookies do not contain any personal data and can therefore not be directly connected to any user.  

The use of cookies serves to make the use of our offer more pleasant for you. We use technically necessary session cookies to recognize that you have already visited individual pages on our website or for language settings. These cookies are automatically deleted after you close the browser. The data processed by cookies are required for the stated purposes to protect our legitimate interests and those of third parties in accordance with Article 6 Paragraph 1 Sentence 1 lit. f GDPR.

Most browsers accept cookies automatically. However, you can configure your browser that no cookies are saved on your computer or that a pop-up message always appears before a new cookie is created. Each browser manages cookie settings differently.  How you can deactivate cookies or change settings is described in your browser’s help menu (see also technical information at the end of this data protection declaration). 

Inquiries by email or telephone

If you contact us by email or telephone, your request including all resulting personal data (e.g. name, request) will be saved and processed by us for the purpose of processing your request. Your data will not be passed on without your consent. There is no legal or contractual obligation to provide your data, but it is not possible to process your request without providing your data. 

The processing of this data is based on Article 6 Paragraph 1 lit. b GDPR in case your request is related to the fulfillment of a contract or is necessary to carry out precontractual measures. In all other cases, the processing is based on your consent (Article 6 Paragraph. 1 lit. a GDPR) and / or on our legitimate interest (Article 6 Paragraph 1 lit. f GDPR), since we have a legitimate interest in the effective processing of all inquiries addressed to us. 

We will save the data sent to us via contact requests (email) until you ask us to delete it, revoke your consent to saving it or until the purpose for data saving no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected. 

Data when using our contact form or booking request – forwarding to the online booking tool. 

When you send us a message via our contact form, you can also use a pseudonym instead of your real name. But entering a valid email address is necessary to enable us to contact you by email. There is no legal or contractual obligation to provide your data, but it is not possible to process your request without providing your data. 

The data you enter in the contact form will exclusively be used to answer the contact as part of your inquiry via the contact form. We do not pass on the data you enter in the contact form to third parties or use this data for any other purpose than to answer your request.   The data is processed either for the purpose of fulfilling a contract to which the data subject is a party, or to carry out precontractual measures (Article 6 I S 1 lit b GDPR), or in accordance with Article 6 paragraph 1 sentence 1 lit. a GDPR on the basis of your voluntarily given consent and / or on our legitimate interest (Article 6 Paragraph 1 lit. f GDPR), since we have a legitimate interest in the effective processing of inquiries addressed to us. 

Your data will be deleted after your request has been finally processed, provided that the deletion does not conflict with any statutory retention requirements.  

When booking through our website, you will be forwarded to an external service provider (Dirs 21 https://www.dirs21.de/ - Borsigstraße 26, 73249 Wernau, Germany, Phone: +49 (0) 7153 9250 0). Insofar the data protection declaration of the external service provider applies, which you can find at https://www.dirs21.de/disclaimer/.

Email advertising and your right to object 

When we have received your email address in connection with a booking/order or service and you have not objected, we reserve the right to regularly send you our offers for similar services on the basis of Section 7 III UWG. The legal basis results from our legitimate interest in advertising to our customers and the processing of the data is permissible under Article 6 I Sentence 1 lit f GDPR as part of balancing interests. 

You can object to the use of your email address at any time by sending us a message or via the corresponding link in the advertising email. After the legal basis for data processing for advertising emails no longer applies, your email address will be deleted, unless there are legal saving obligations (e.g. from tax or commercial saving obligations) to the contrary.  

We would also like to point out that you can object to the future processing of your personal data at any time in accordance with the legal requirements of Article 21 GDPR. The objection can be made in particular against processing for direct advertising purposes. 

Postal advertising and your right to object

We reserve the right to use your first and last name as well as your postal address, which you have given us when booking, for our own advertising purposes, e.g. to send you interesting offers by mail. This serves to maintain our overriding legitimate interests in advertising to our customers in accordance with Article 6 Paragraph 1 Sentence 1 lit. f DGPR.

You can object to the saving and use of your data for these purposes at any time by sending us a message. The objection can be made in particular against processing for direct advertising purposes. After the legal basis for data processing for postal advertising no longer applies, your address data will be deleted unless there are statutory retention requirements to the contrary.   

Data protection when sending application documents

When you send us your application documents, we will only use them to decide on your application and will not pass your data on to third parties. We would like to point out that we currently do not offer any encryption of your data when sending application documents by email. 

However, you can email your attachments, e.g. with the program 7ZIP (http://www.7-zip.de/), in encrypted form and tell us your password separately, e.g. on the phone. You will receive an email message from us to your email address that we have received your application. You can also send us your application by postal service at any time. 

Application data is kept and managed separately from other data sets. 

If we conclude an employment contract with an applicant, the transmitted data will be saved for the purpose of processing the employment relationship in compliance with the statutory provisions. If no employment contract is concluded with the applicant, the application documents will be automatically deleted no later than six months after notification of the rejection decision, provided that deletion does not conflict with any other legitimate interests of the person responsible for processing or the applicant expressly requests that his/her application be saved and retained for a longer period of time, e.g. if he/she has consented to possible subsequent contact with vacancies. Another legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

Data processing for the purpose of establishing contact and processing your application data takes place in accordance with Article 6 Paragraph 1 Sentence 1 lit. a, b GDPR on the basis of your voluntarily given consent, as well as to carry out pre-contractual actions. 

Use of data when ordering vouchers online

We collect personal data if you voluntarily provide it to us as part of your order or when contacting us (e.g. via the contact form or email). 

Which data is collected can be found on the respective form

We only use the data you provide to process the contract and your inquiries. After your inquiry has been finally answered or the contract has been processed in full, your data will be blocked for further use and deleted after the retention periods under tax and commercial law have expired. 

The legal basis for data processing is Article 6 Paragraph 1 Sentence 1 lit. a, b GDPR.

Data transfer to shipping service providers when delivering vouchers

In order to fulfill the contract, we pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods ordered. The legal basis for data processing is Article 6 Paragraph 1 Sentence 1 lit. b GDPR.

Data transfer to payment service providers when ordering vouchers

In order to fulfill the contract, we pass on your data to the company commissioned with the payment, insofar as this is necessary to pay for the goods ordered. Depending on which payment service provider you select in the ordering process, we pass on the payment data collected for this purpose to the credit institution commissioned with the payment and, if applicable, to the payment service provider commissioned by us or to the selected payment service to process payments. Some of the selected payment service providers also collect this data themselves if you create an account there. In this case, you must register with the payment service provider with your access data during the ordering process. In this case, the data protection declaration of the respective payment service provider applies

The legal basis for data processing is Article 6 Paragraph 1 Sentence 1 lit. a, b GDPR.

PayPal

On our website we offer, among others, payment via PayPal. The provider of this payment service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter ‘PayPal’).

If you choose to pay via PayPal, the payment details you enter will be sent to PayPal.

Your data is transmitted to PayPal on the basis of Article 6 Paragraph 1 lit. a GDPR (consent) and Article 6 Paragraph 1 lit. b GDPR (processing to fulfill a contract). You have the option to revoke your consent to data processing at any time. A revocation does not affect the effectiveness of past data processing operations.

Online presence in social networks

We operate online presences in social networks for advertising purposes.

We would like to point out that you use the social services and their functions at your own risk. This applies in particular to the use of interactive functions (e.g. sharing, rating).

When you visit our online presence in social media, personal data will be collected and processed by the respective provider for advertising and market research purposes. Generally, user profiles are also created here. This is particularly the case if you are a member of the respective platform and are logged in to it. The user profiles can be used by the providers to show you interest-based advertising. To prevent social media operators from collecting information about you during your visit to our website, you should log out of the respective social medium before you start visiting our website and delete any social media cookies from your browser. 

Open Street Maps

On our website we use the geo-data of the open source map service ‘Open Street Maps’ (also called ‘OSM’) of the Open street map Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom (Company Registration Number: 05912761).

This service enables us to display our website and the map displayed on it in a pleasant way. When the map data is retrieved, your IP address and the information that our website was accessed are transmitted to the OSM servers. The legal basis for the processing of your data is Article 6 I S 1 lit f GDPR. Our legitimate interest results from our need for an attractive presentation of our online offer and for the easy traceability of the locations specified on our website.

Data security

We use the SSL (Secure Socket Layer) method for encryption on our website. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed representation of the key or padlock symbol in the lower status bar of your browser. 

Processing/sharing of data

Your personal data will not be transmitted to third parties for purposes other than those listed above or below. 

We only pass on your personal data to third parties if:

  • You have given your explicit consent in accordance with Article 6 Paragraph 1 Sentence 1 lit. a GDPR, 
  • This is permitted by law and is required under Article 6 Paragraph 1 Sentence 1 lit. b GDPR for the fulfillment of contractual relationships with you in order to carry out pre-contractual actions, 
  • In case that there is a legal obligation for us to pass on the data pursuant to Article 6 Paragraph 1 Sentence 1 lit. c GDPR 
  • Processing according with Article 6 Paragraph 1 Sentence 1 lit. f GDPR is necessary to protect our legitimate interests or those of a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data prevail, in particular when the data subject is a child.

Data subject rights

You have the right to:

  • to request information about your personal data processed by us in accordance with Article 15 GDPR.
  • in accordance with Article 16 GDPR, to immediately request the correction of incorrect or incomplete personal data saved by us
  • according to Article 17 GDPR, to request the deletion of your personal data saved by us, unless the processing is necessary to exercise the fight to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims required  
  • in accordance with Article 18 GDPR to demand the restriction of processing your personal data if you dispute the accuracy of the data, if the processing is unlawful, but you refuse to delete it and we no longer need them to assert them, but you however need this to assert, exercise or defend legal claims or you have objected to the processing in accordance with Article 21 GDPR 
  • according to Article 20 GDPR, to receive your personal data that you have provided to us in a common and machine-readable format or to request transmission to another person responsible
  • according to Article 7 GDPR, to revoke your consent given at any time. As a result, we are no longer allowed to continue processing your data for the future based on this consent. 
  • in accordance with Article 77 GDPR, to complain to a supervisory authority if you believe that the processing of your personal data violates the GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or work or our headquarters. Right to object

You have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data, which is based on Article 6 Paragraph 1 letters e or f. We will no longer process your personal data after you have objected, unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing servers to assert, exercise or defend legal claims. If you would like to make use of your right to object, an email to us is sufficient. 

Changes to this data protection declaration – as of  

Due to further development of our website and offers or due to changed legal or official requirements, it may become necessary to change this data protection declaration in compliance with the applicable data protection regulations. You can access and print out the current data protection declaration at any time on our website under data protection.
